Вернуть клиенту ранее списанные со счета деньги должен будет один из крупнейших банков России. Чтобы вернуть честно заработанное, жителю подмосковного Одинцова пришлось дойти до Верховного суда.

Как выяснил суд, в течение нескольких дней 2022 года мужчина провел 96 операций по конвертации валюты (доллары и евро), и успел неплохо подзаработать. Дело в том, что в удачный для гражданина момент курс валют в банке, который его обслуживал, был заметно ниже курса Банка России и биржевого курса. Путем перепродажи валюты он сумел серьезно улучшить свое благосостояние.

Когда в банке обнаружили подозрительную активность клиента, с его счетов списали без малого 70 тыс. евро, а сами счета (всего их было четыре) заблокировали.

Мужчину это не устроило, он потребовал от банка вернуть заработанное, однако ему отказали. Тогда он обратился в суд, попросив вернуть ему деньги, а также компенсировать моральный вред (его он оценил в 100 тыс. рублей) и уплатить штраф.

Одинцовский суд отнесся к клиенту банка с пониманием: постановил вернуть деньги, уплатить штраф (более двух миллионов рублей). Правда, моральный вред оценил скромнее: 10 тыс. рублей.

Но затем дела предприимчивого одинцовца пошли не по плану: Мособлсуд встал на сторону банка, так же, как и Первый кассационный суд общей юрисдикции. Банк аргументировал свои действия тем, что обогатиться ему помогла ошибка сотрудника, который указал неверные данные о банковском валютном курсе.

Пришлось обращаться в Верховный суд. И в высшей инстанции пришли к выводу, что правда все же на стороне клиента. В определении суда указано, что гражданин действовал на основании официальных данных о курсе валют, опубликованных на сайте, эта же информация была доступна и другим клиентам. То есть, с юридической точки зрения он ничего не нарушил, действовал в рамках закона, его вины в том, что банком была допущена ошибка, нет. Поэтому решения апелляции и кассации отменены, дело отправлено на новое рассмотрение в Мособлсуд.
